Digital signatures vs. advanced electronic signatures: what is the difference?
Digital and advanced electronic signatures are increasingly used in business processes and electronic document management. Both offer an efficient, secure alternative to signing paper documents. What is the difference, and how can their use benefit you?
A digital signature is a tool for adding an electronic signature to a document. It is based on cryptographic technology and, in Legal Shelf’s case, facial biometrics, to help verify that the person signing is who they claim to be. Digital signatures can be used for contracts, agreements, letters and other documents requiring a signature.
An advanced electronic signature uses additional authentication techniques to support the document’s authenticity and integrity. It uses identity and signature verification to establish that the document has not been altered and that the signatory is who they claim to be. Two files are used: .CER, .KEY and your personal password. Advanced electronic signatures are also specifically regulated in Mexico and provide additional legal assurance compared with a simple digital signature.
What are the benefits of these tools? First, they reduce waiting times when exchanging important documents. Electronic signatures let yousign and send documents in minutes, without waiting for paper documents to be printed and signed, helping make business processes more efficient.
Second, these tools strengthen document security and reduce fraud risk. The cryptographic and authentication techniques used in electronic signatures provide security features beyond those of paper signatures. Specific legal regulation also supports their legal validity and helps reduce disputes.
Digital signatures reduce the costs of signing paper documents. Removing the need to print and send paper documents lowers printing and shipping costs, producing savings for companies.
In Mexico, both simple digital signatures and advanced electronic signatures can be secure and legally valid. The choice depends on the user’s specific needs and the legal context, and where electronic signing needs do not require additional security and confidentiality measures, a simple digital signature may be sufficient. If you need greater security and confidentiality for electronic signatures, consider an advanced electronic signature.
However, an advanced electronic signature is recommended where a dispute is likely over the signature or document in a business agreement, transaction or high-value operation involving important or confidential records. An advanced electronic signature requires personal identification of the signatory and a digital certificate issued by a certification authority recognized by the Mexican government, supporting the signed document’s authenticity and integrity. Mexico’s Advanced Electronic Signature Law establishes that an advanced electronic signature is equivalent to a handwritten signature.
Digital and advanced electronic signatures are efficient, secure tools for signing electronic documents. Their use reduces waiting times, strengthens security and lowers the costs associated with signing paper documents. If your company does not yet use them, consider adopting them to improve efficiency and security in your business processes.
